Every dispute is unique to the parties involved. For instance, where sensitive matters are involved, the mediator will keep all information confidential. Matters discussed in mediation are not made part of the court record. Further, parties participate directly in a facilitated negotiation process in which each makes his or her own decisions. Mediation works and agreements last because the process is voluntary and client driven. Further, agreements are contractually binding once signed by the parties, and may become enforceable as court decrees if the parties wish. The process can begin when the parties decide, and move at a pace that suits their schedules. Mediation costs far less than other forms of dispute resolution, especially litigation. Throughout the process, a party retains the right to seek counsel or have counsel present. In fact, The Center for Law & Mediation welcomes attorneys into the process to counsel participants and help facilitate negotiation.
In addition, mediation can help resolve other types of disputes, such as, civil rights violations, consumer complaints, neighborhood disagreements, allocation of business or personal finances, elder law issues and disability related complaints. Of course, mediation requires clients to take a certain amount of responsibility for the outcome of his or her case. Each party must come prepared to exchange information regarding the dispute as thoroughly as possible. Every party must understand the priorities for resolution, and all participants must be prepared to clearly express the important interests in the matter. As the mediator is bound to remain neutral, each party must come prepared to listen to the interests of the other. This obligation to listen does not mean that a party must come prepared to agree. Instead, a participant should be willing to listen in order to understand, but not necessarily to agree. It is the mediators job to help the participant stake holders find a common ground which they can use to resolve the dispute and reach the higher ground of win-win resolution.
